CONTINGENT FEE AGREEMENT

I hereby retain the Law Office of Miniat & Wilson, P.C. to represent me.  I agree to pay as a fee for your services 25% of the total amount obtained by settlement before commencement of trial or hearing.  

If no recovery is obtained, I will pay no legal fee.

If the matter requires litigation and recovery occurs after hearing or trial commences, I agree to pay 33 1/3% of the total amount.

In the event of an award designated as and for attorney's fees, such award shall be paid attorney as an addition to and not in lieu of the contingent fee.  

I understand the attorneys may incur costs and expenses in the prosecution of this claim, which may include fees from court clerks, process servers, witnesses and court reporters, long distance, photo copying, travel and exhibit preparation.  If the attorneys advance these costs, I consent to reimbursement out of any funds recovered.

I understand that you will use your best efforts in handling my case, but that you cannot guarantee results. I further understand that if during the presentation of my case you determine that, in your opinion, it is not feasible to continue with the case, you may, after due notice to me, withdraw.  I retain the right to terminate the agreement, in which case I will repay attorneys any advanced costs and will compensate them for services rendered based on Arizona ethical standards.
